Terms of Service Required

Terms of Service

  • MS Co., Ltd. has reflected the relevant laws and regulations to ensure the safety of personal information protection for our members. These Terms of Service take effect from December 10, 2025.

Article 1 (Purpose)

These Terms of Service (the “Terms”) define the conditions for users to register as members and use the internet-related services (the “Services”) provided by MS Co., Ltd. (the “Company”) or its affiliates on https://msparkzon.com (the “Website”), as well as the rights, obligations, and responsibilities of users regarding the use of the Services.

Article 2 (Definitions)

Terms used in these Terms shall have the following meanings. Any term not defined herein shall follow applicable laws or general practice.

  1. 1. “Mall” means a virtual business place established by the Company using information and communication facilities to allow transactions of goods or services (“Products, etc.”).

  2. 2. “User” means any person who accesses the Mall and receives Services in accordance with these Terms, including members and non-members.

  3. 3. “Member” means a User who agrees to these Terms and the privacy policy, enters into a service agreement, and continuously uses the Services.

  4. 4. “Non-member” means a User who uses the Services without registering as a Member.

  5. 5. “Business Owner” means any person who purchases MS Golf products and operates a business for profit at a store.

  6. 6. “Business Location” means a store where MS Golf products are installed and approved by the Company to provide Services.

  7. 7. “Post” means content posted within the Services by the Company or Members, including text, images, files, links, etc.

  8. 8. “Service Agreement” means all agreements between the Company and Members related to the use of the Services, including these Terms.

Article 3 (Posting, Explanation, and Amendment of Terms)

  1. 1. The Company shall post these Terms, its business name, representative name, address (including consumer complaint contact), phone number, fax number, email address, business registration number, e-commerce registration number, and personal information manager on the main service screen so Users can easily access them. The Terms may also be provided through a linked screen.

  2. 2. Before agreeing to these Terms, Users shall be provided with important information such as order cancellation, shipping responsibility, and refund conditions via a linked screen or popup so that Users can review them.

  3. 3. The Company may revise these Terms within the scope permitted by applicable laws.

  4. 4. If the Company revises these Terms, the Company shall announce the effective date and reason for revision, together with the current Terms, on the main screen from at least seven (7) days before the effective date until the day before the effective date.

  5. 5. Members are responsible for checking the Website for updates. The Company is not liable for damages caused by a Member’s failure to review updated Terms.

  6. 6. Matters not specified herein and interpretation of these Terms shall follow applicable laws including consumer protection laws for e-commerce, the regulation of standard terms, and relevant guidelines and practices.

Article 4 (Supplementary Rules)

The Company may establish separate terms or operating policies (“Additional Terms”) for specific services. If these Terms conflict with Additional Terms, the Additional Terms shall prevail.

Article 5 (Formation of Service Agreement)

The Service Agreement is formed when the User agrees to the Service Agreement, applies to use the Services, and the Company approves the application.

Article 6 (Service Application)

  1. 1. Users who wish to register as Members must agree to these Terms and provide required information such as ID, password, name, and contact details.

  2. 2. Members must provide their own accurate information. Members who use stolen or false information may not claim any rights and may be punished under applicable laws.

  3. 3. The Company may verify the authenticity of information, and Members must cooperate. Failure to cooperate may be deemed as providing false information.

  4. 4. The Company may differentiate service access by membership level, including usage time, frequency, and available menus.

  5. 5. The Company or its designated party may receive written information from an applicant and proceed with the online registration process on the applicant’s behalf.

Article 7 (Approval and Restrictions)

  1. 1. In principle, the Company approves applications in the order they are received.

  2. 2. The Company may withhold approval in the following cases:

    • a) The applicant did not provide accurate personal information;
    • b) The application is intended to violate laws, public order, or social norms;
    • c) The service is intended for illegal purposes such as gambling;
    • d) The service is intended for commercial gain;
    • e) The applicant is in a competitive relationship with the Company;
    • f) The applicant previously had the agreement terminated due to violations;
    • g) The applicant fails to pay amounts owed related to purchases or service use;
    • h) Other cases where laws or these Terms are violated.
  3. 3. The Company may defer approval until restrictions are resolved, including:

    • a) Insufficient capacity of facilities;
    • b) Technical difficulties;
    • c) Other operational reasons.
  4. 4. The Company may defer approval until the above restrictions are resolved.

  5. 5. If the applicant is a minor under 20 years old, approval may be deferred according to service-specific guidance.

  6. 6. If any grounds in Paragraph 2 are found after registration, the Company may revoke approval.

Article 8 (Protection and Use of Personal Information)

  1. 1. The Company strives to protect Members’ personal information in accordance with applicable laws and the Company’s privacy policy.

  2. 2. The privacy policy does not apply to external sites linked from the Website.

  3. 3. Members must manage their passwords to prevent exposure. The Company is not responsible for leaks caused by the Member’s negligence.

  4. 4. Personal information shall not be used beyond its purpose or provided to third parties without consent, except where permitted by law, such as:

    • a) Requests by investigative or government agencies;
    • b) Fraud prevention and security purposes including verification of violations;
    • c) Providing minimum information to delivery providers for shipping;
    • d) Statistical analysis, academic research, or market surveys in anonymized form;
    • e) Payment processing related to transactions;
    • f) Identity verification to prevent misuse;
    • g) Other cases required by law.
  5. 5. The Company is not responsible for personal information provided by Members to third parties, including business owners.

  6. 6. The Company collects only minimum necessary information. Mandatory items may include:

    • a) Name;
    • b) Address;
    • c) Phone number;
    • d) Desired ID (for members);
    • e) Password (for members);
    • f) Email address (or mobile phone number);
    • g) Connection information (CI);
    • h) Duplicate registration verification information (DI).
  7. 7. The Company must obtain consent when collecting personally identifiable information.

  8. 8. Users may request access/correction of their personal information, and the Company will take action without delay.

  9. 9. The Company limits administrators and is responsible for damages caused by loss, theft, leakage, or alteration of personal information due to the Company’s fault.

  10. 10. When the purpose of collection/use is fulfilled, the Company shall destroy the personal information without delay.

Article 9 (User ID Assignment and Changes)

  1. 1. The Company assigns a User ID in accordance with these Terms.

  2. 2. In principle, a User ID cannot be changed. If unavoidable, the User must terminate the existing ID and reapply.

  3. 3. With consent, the Website User ID may be linked with IDs on other sites operated by the Company or its affiliates.

  4. 4. A User ID may be changed upon request or suspended by the Company in the following cases:

    • a) The User ID contains a phone number or resident registration number, raising privacy concerns;
    • b) The User ID is offensive or violates public morals;
    • c) The User ID is identical to or easily confused with the Company or service name;
    • d) Other reasonable grounds exist.
  5. 5. Members are fully responsible for managing their ID and password. The Company is not liable for damages caused by negligence.

  6. 6. Other matters follow service-specific guidance.

Article 10 (Obligations of the Company)

  1. 1. The Company shall provide services from the requested start date unless special circumstances prevent it.

  2. 2. The Company shall promptly repair/restore facilities for stable service unless unavoidable.

  3. 3. The Company discloses its privacy policy and strives to protect personal information.

  4. 4. The Company shall address reasonable complaints promptly. If delayed, the Company will notify reasons and schedule.

Article 11 (Obligations of Members)

  1. 1. Members must provide truthful information when registering or updating their profile.

  2. 2. If a Member registers false information or uses another person’s information, they may not claim rights.

  3. 3. Members must comply with applicable laws, these Terms, additional terms, and announcements.

  4. 4. Members must not interfere with the Company’s operations, harm reputation, or cause damage to others.

  5. 5. Members must promptly notify changes via profile update. The Company is not liable for damages caused by failure to notify.

  6. 6. Members may not use the service for commercial activities without prior approval. The Company may restrict service and claim damages if losses occur.

  7. 7. Members may not transfer, gift, or pledge service rights without the Company’s consent.

  8. 8. Members must not infringe intellectual property rights or engage in acts specified in Article 18.

Article 12 (Service Hours)

  1. 1. The service operates 24/7 in principle. The Company may temporarily suspend service for maintenance with prior notice.

  2. 2. In emergencies (failures, overload, national emergency, outage, etc.), service may be suspended without prior notice.

  3. 3. If service changes are necessary, the Company may suspend all or part of the service after prior notice.

Article 13 (Member Posts)

  1. 1. Members are fully responsible for issues caused by their posts.

  2. 2. The Company may suspend, modify, delete, move, or reject posts without prior consent if they:

    • a) Defame or insult third parties;
    • b) Violate public order or morals;
    • c) Promote illegal copying/hacking;
    • d) Are advertisements for profit;
    • e) Are objectively related to crime;
    • f) Infringe copyrights or intellectual property rights;
    • g) Are political/religious content unsuitable for the service nature;
    • h) Violate relevant laws.
  3. 3. If a third party requests suspension due to defamation/IP infringement and the Company deems it valid, the Company may temporarily suspend the post.

  4. 4. Members may request reposting. If justified, the Company may restore it, but will follow legal decisions/settlements when applicable.

Article 14 (Copyright)

  1. 1. Copyright and intellectual property rights of content created by the Company belong to the Company.

  2. 2. Copyright of member posts belongs to the member. However, the Company may use posts for service operation, display, transmission, distribution, and promotion within a reasonable scope as permitted by law.

  3. 3. For uses beyond the above scope, the Company shall obtain prior consent.

  4. 4. If a member terminates the agreement, posts recorded under the account may be deleted.

Article 15 (Provision of Information)

  1. 1. The Company may provide information via email, mail, SMS, phone, etc. as necessary for service operation.

  2. 2. With consent and in compliance with law, the Company may collect additional information for service improvement/marketing.

Article 16 (Advertisements)

  1. 1. Users agree that advertisements may be displayed while using the service.

  2. 2. The Company is not responsible for damages from transactions between members and advertisers.

Article 17 (Changes and Termination)

  1. 1. Members may terminate the agreement through account cancellation.

  2. 2. If the Company terminates a member account, it will notify and provide an opportunity to explain before deletion, in accordance with the privacy policy.

  3. 3. If the Company revises these Terms, it will announce the effective date and reason at least seven (7) days prior to the effective date.

Article 18 (Service Restrictions)

  1. 1. The Company may restrict use, reset data, or terminate the agreement if a Member violates these Terms or engages in:

    • a) Registering false information or using others’ credentials;
    • b) Trading or providing a user ID to others;
    • c) Distributing obscene/illegal content or content infringing rights;
    • d) Harassing or threatening others;
    • e) Unauthorized modification/hacking of systems or content;
    • f) Using information obtained via service for other purposes without consent;
    • g) Impersonation or disrupting service operation;
    • h) Corrective action request from public agencies;
    • i) No service usage for 3 months or more;
    • j) Other violations of laws or Company rules.

Article 19 (Damages)

  1. 1. If either party causes damage to the other due to intent or negligence, the responsible party shall compensate.

  2. 2. The Company is not liable for damages related to free services unless otherwise stipulated in the privacy policy.

Article 20 (Disclaimer)

  1. 1. The Company is not liable for failure to provide service due to force majeure (disasters, war, telecom outage, etc.).

  2. 2. The Company is not liable for damages caused by unavoidable maintenance or facility work.

  3. 3. The Company is not liable for damages due to user device errors or inaccurate user information.

  4. 4. The Company does not guarantee expected profits and is not liable for losses related to use of the service.

  5. 5. The Company is not responsible for accuracy/reliability of user-posted information and does not intervene in disputes between users/third parties.

  6. 6. The Company has no obligation to pre-screen user posts.

Article 21 (Notices)

  1. 1. Notices may be delivered via the email address registered by the Member.

  2. 2. For notices to many members, the Company may substitute individual notice by posting on a board for at least seven days.

Article 22 (Cash Points)

  1. 1. Cash points are cyber points earned through events/services on the Website. They cannot be sold or transferred.

  2. 2. Cash points cannot be exchanged for cash and cannot be used for transactions unless separately specified.

  3. 3. The Company may adjust usage or expire unused points with prior notice.

Article 23 (Mall Operation)

  1. The Mall performs the following:

    • a) Providing information and concluding purchase contracts;
    • b) Delivering goods/services under concluded contracts;
    • c) Other tasks defined by the Mall.
  2. 2. If products become unavailable or specs change, the Mall may change the contents for future contracts and will promptly announce details and effective date.

Article 24 (Relationship Between Linked Malls)

  1. 1. If a main mall and a linked mall are connected via hyperlinks, they are referred to as the linked mall and the sub linked mall.

  2. 2. The linked mall does not assume warranty/liability for transactions between the user and the sub linked mall.

Article 25 (Mid-Term Refund for Content)

  1. 1. Content is eligible for mid-term refund except items provided free of charge, gifted content, one-time content, and non-refundable content notified in advance.

  2. 2. Refunds will be processed within five (5) business days from the receipt of the request.

  3. 3. The refund amount is calculated by deducting the used portion and a refund processing fee (10% of the original price), as applicable.

Article 26 (Remedies)

  1. 1. If service interruption occurs without prior notice due to force majeure or third-party illegal acts, the Company may extend service for the interruption period (excluding member-attributable causes).

  2. 2. If purchased content is lost due to the Company’s fault, the Company will restore it or provide alternative content/refund if restoration is not feasible.

Article 27 (Sanctions for Improper Use)

  1. 1. The Company may suspend accounts or revoke content access for improper use, with prior notice unless urgent action is required.

  2. 2. The Company will provide evidence and allow members to explain.

  3. 3. If the member proves no fault, the Company may extend the usage period by the suspension period.

  4. 4. Members shall compensate damages caused by improper use.

Article 28 (Jurisdiction and Governing Law)

  1. 1. Matters not specified herein follow applicable laws and general practices.

  2. 2. For paid services, separate terms/policies may apply.

  3. 3. Courts having jurisdiction over the Company’s principal office shall have exclusive jurisdiction.

Supplementary Provisions

These Terms take effect from December 10, 2025.

  2. - Delivery, billing, prize distribution, and purchase notifications: name, address, phone number, etc.

  3. - Notices, identity verification, complaint handling, marketing and event information: email address, mobile phone number, etc.

  4. - Payment information for billing: bank account information, credit card information, etc.

  5. - Store usage information transmission: mobile number, nickname, gender, date of birth, store visit frequency, etc.

  6. - Data for personalized services: other optional items.
